An application shall be submitted, and will be received for filing, only for the purpose of claiming a preference right to the tidelands conveyed by the state to the borough under AS 38.05.820(b).

A. Application forms will be provided by the clerk without charge.

B. An application must be submitted in triplicate.

C. An application that is neither clearly legible nor properly completed and certified by the applicant will not be accepted for filing. Willful and deliberate misstatements of fact will be considered equivalent to attempting to obtain property by misrepresentation and/or under false pretenses.

D. Each application must be accompanied with affidavits from two persons having personal knowledge of the improvements made by the applicant to the tidelands.

E. An application may be delivered or mailed to the clerk, Haines Borough, Box 1049, Haines, Alaska, 99827 with the proper deposit computed according to the nature of the application made. A properly completed application accompanied with the proper deposit will be stamped with the time and date of filing and signed by the person accepting the deposit. The triplicate copy will then be returned to the applicant by personal delivery or mail.

F. An application for a deed based on an asserted right other than a preference right shall be rejected.

G. An application based on more than one class of preference right, except an application for a single subdivided lot, shall not be accepted for filing.

H. An application claiming title to two or more lots that are not contiguous shall not be accepted for filing.

I. An application rejected by reason of subsection (G) or (H) of this section shall be returned to the applicant by personal delivery or mail.
