A. Receiving and Filing. The clerk shall receive and file applications as follows:

1. All copies of an application accepted for filing shall be stamped with time and date of filing and an application number in chronological order of filing.

2. Each original application shall be filed in a permanent register and the name of the applicant entered in an alphabetical index which shall be a permanent part of such register.

3. The application register shall be available for public inspection during office hours of the clerk except when in actual use for filing and indexing.

4. A certified copy of an application shall be prepared for any person upon request and payment of $1.00 per page for copies of said application and any attachments forming a part thereof.

5. The third copy of an application will be returned to the applicant by personal delivery or mail as the applicant’s record and as receipt for deposits made. The second copy shall be the working file copy.

B. Processing. The clerk shall process an application as follows:

1. An application to exercise a Class I or Class II preference right which contains a proper legal description of only a lot or lots shown on the tidelands subdivision plat and does not include any unoccupied and unimproved tidelands, or any land occupied or improved by the borough, shall be processed by the clerk as provided in HBC 14.14.160.

2. An application to exercise a Class III preference right, and any application determined in whole or in part to be Class III, shall be transmitted to the assessor/land manager for appraisal as provided in HBC 14.14.150.

3. An application to exercise any Class of preference right which does not contain a proper legal description of a lot or lots shown on the tidelands subdivision plat shall be rejected and returned to the applicant for completion. Once complete, the application shall be processed by the clerk as provided in HBC 14.14.150.

4. Except as otherwise provided in HBC 14.14.110(G), the clerk may not accept for filing an application that combines two or more classes of preference rights. Any such application presented for filing shall be returned to the applicant with directions that the applicant revise the application into two or more applications, each of which apply for land under one class of preference right.
