A. A new service area may be established only after the assembly determines that such services cannot reasonably be provided by an existing service area, or under an existing area-wide power.

B. Whether to establish a new service area shall be based upon a criteria of need, safety, and economic operating efficiency and may only comprise the area to which the services will be provided.
