A. The ordinance establishing a service area may provide for appointed or elected boards of persons from within the service area to make recommendations concerning services or other purposes, as permitted by statute. If the assembly determines that an appointed or elected board is not necessary, or if a board lacks the minimum membership required by the ordinance establishing that board, the assembly shall perform the functions of such board. “Persons from within the service area” shall mean a Haines Borough registered voter who either maintains their primary residence within the service area (regardless of ownership) or who owns real property located within the service area, unless otherwise specified for a specific service area board. Service area boards with fewer than three members shall be comprised of members representing different parcels.

B. Service area board members may be removed in accordance with HBC 2.04.060.

C. Unless otherwise provided by ordinance, a vacancy in a service area board seat shall be filled by appointment by the mayor, subject to confirmation of the assembly, for the remaining term of the vacant seat.
