The purpose of this chapter is for the borough, as successor to the rights and responsibilities of the former city of Haines, to carry out the function and duty of the former city with respect to the application for and adjudication of claims to certain preference rights to tide and submerged lands to which the former city was entitled under AS 38.05.820(b), Alaska Land Act.

The intent of the assembly in enacting this chapter is:

A. To expedite granting conveyances to qualified occupants who are entitled to and who exercise their preference rights in accordance with the provisions of law and of this chapter;

B. To provide due process and sufficient notice to all parties who qualify as occupants of lands subject to AS 38.05.820(b) and who are entitled to exercise preference rights of applications filed, of disputes and conflicting claims, and of approved applications;

C. To provide a simple procedure by which occupants may exercise their preference rights;

D. To equitably apportion the costs of administering and processing applications, hearing disputes, costs of appraisal, transfer, and survey among those who will benefit therefrom;

E. To limit the issues to be determined by the assembly in adjudication of disputes to rights conferred by AS 38.05.820 and this chapter;

F. To safeguard and protect the interests of the borough and its citizens in tide and submerged lands conveyed to the borough under AS 38.05.820(b) by providing for the administration of such lands in the best interests of all of the residents of the borough.
